Introduction
CA2 Inc. (“CA2”) is committed to protecting your privacy and the secure handling of your information.
This Privacy Statement applies solely to personal information managed by CA2 and describes what information is collected, how it is used, and who it is shared with.
Personal information is defined as information about an identifiable individual, excluding business contact information. This Privacy Statement outlines how CA2 handles personal information.
The purpose for which CA2 collects personal information will be identified at or before the time the information is collected. Personal information may be collected for such purposes as:
- Notifying you of your legal rights pursuant to court order;
- Submitting your class action claim form online;
- Establishing eligibility and entitlement; and
- Administering the terms of settlement.
CA2 will not use personal information for any other purpose than identified at or before the time of collection.
CA2 seeks consent for all personal information it collects, uses and discloses through information provided to individuals prior to collection, or at the time of collection.
If information is voluntarily provided, this is interpreted as consent to the collection, use and disclosure of personally identifiable information as described in this Privacy Policy. As required by the CSA Model Code for the Protection of Personal Information, CA2 will not use personal information for any purpose other than that for which consent has been provided. Should CA2 require use of personal information for a new purpose, consent will be sought for that new use.
What information is collected?
In order to fulfil CA2’s court mandated or client engagement responsibilities, various types of information are collected, including:
- Contact information (i.e. name, address, telephone/email #, date of birth, etc.)
- Unique identifiers (i.e. account #, policyholder #, health insurance #, etc.)
- Detailed information (i.e. transactional data, financial records, medical history, etc.)
The information we collect may be obtained (i) directly from you, (ii) automatically when navigating our website, and (iii) from third parties including, defendants, suppliers, and other individuals.
How is your information used?
CA2 uses the information collected for the following purposes:
- Establish your eligibility to participate in a settlement;
- Determine the amount of your benefit entitlement;
- Distribute legal notices and compensation payments; and
- Satisfy our responsibilities pursuant to appointment by the court(s).
CA2 does not collect information for marketing purposes.
Who is your information shared with?
CA2 may share the information collected as directed by the court(s) or as specified under the terms of settlement. CA2 may share the information collected with its employees, subcontractors, owners, counsel for the settling parties, and service providers in performing its court ordered role. CA2 may further share the information collected in order to investigate, prevent or otherwise take action with respect to fraudulent activities and/or as required by law.
CA2 does not sell or trade any personal information with third parties. Information may be transferred to third parties where information processing is outsourced by CA2 in the course of its activities or administrative procedures in specific cases. Some personal information collected by CA2 is transferred to our service providers for processing and storage. CA2 requires service providers to respect this Privacy Statement. Service providers are restricted from using or disclosing personal information transferred to them for any purpose other than the provision of services to CA2.
How long is your information is kept?
CA2 retains personal information only as long as is necessary to fulfill the purposes described in this Privacy Statement. In some cases, legal reporting or retention requirements necessitate that CA2 retains information for a specific amount of time. In general, CA2 retains personal information for a period not longer than seven years, in secure storage.
Any personal information that CA2 retains is kept in such a manner as to ensure its security and confidentiality at all times. Personal information is stored in electronic and physical files that are secure. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while CA2 strives to protect personal information, it cannot ensure or warrant the security of any information transmitted to it or received from it electronically. This is especially true for information transmitted via e-mail. CA2 has no way of protecting that information until it reaches it. Once a transmission is received, CA2 makes its best efforts to ensure its security on its servers. Internally, access to personal information is restricted to employees who need access to the information in order to do their jobs. These employees are limited in number, and are knowledgeable about and committed to the Privacy Statement.
Changes to our Privacy Statement
CA2 reserves the right to change this policy and it may be updated periodically. These changes may affect the use of personal information. Accordingly, please check for changes regularly.
