GLGI Gift Program Class Action

Important updates

The Class Action was certified on June 26, 2019.

The Opt Out Deadline was March 6, 2020 at 5:00 pm EST. It is no longer possible to opt out of this class proceeding.

A settlement with Wise, Blackman LLP was approved by the court on March 14, 2022.

A settlement with Morris Kepes Winters LLP, Robert Kepes and Morris & Morris LLP was approved by the court on August 19, 2020.

There will be no distribution of money to the Class from these settlements. The settlement funds are being used for the costs of the ongoing prosecution of the class action. The class action is still being pursued against nine other defendants.

Introduction

CA2 Inc. was appointed by the Ontario Superior Court of Justice as the Notice Administrator of the Wintercorn et al. v. Global Learning Group Inc. et al. matter.

The Ontario Superior Court of Justice certified the matter as a class action and appointed Lynn Wintercorn, Peter Newman, Emily Flammini, and Alex Kepic as the representative plaintiffs. This class action seeks reimbursement to the Class Members of the money that they paid to participate in the GLGI Gift Program as well as the interest and penalties that may have been assessed by Canada Revenue Agency.

You are a “Class Member” if: you participated in the Global Learning Gifting Initiative Charitable Donation program (“the Gift Program”), and you are not one of the Defendants, their family members, employees, agents, assigns, parent or subsidiary or affiliated companies, or any person or entity who provided services to one or more of the Defendants in respect of the creation, promotion, marketing or sale of the Gift Program, including any sales agents or distributors, and exclusive of Juanita Mariano, Douglas Moshurchak, Sergiy Bilobrov, Melba Lapus, Lylyne Santos, the Estate of Penny Sharp, and Janice Moshurchak, and if you did not opt out of this class action.

If you are a Class Member who wishes to participate in the lawsuit, then you do not need to do anything more at this stage.

On August 19, 2020, the Court added Robert Kepes and Morris & Morris LLP as defendants and approved a settlement with them and the defendant Morris Kepes Winters LLP (the “MKW Settlement”). Under the MKW Settlement, these defendants paid $1.450 million, and the action has been dismissed against them, in exchange for a comprehensive release. There will be no distribution of settlement money to the Class from this settlement.

On March 14, 2022, the Court approved a settlement the defendant Wise, Blackman LLP (the “WB Settlement”). Under the WB Settlement, the defendant paid $500,000, and the action has been dismissed against them, in exchange for a comprehensive release. There will be no distribution of settlement money to the Class from this settlement.
